Terms and Conditions

Max Trekking & Expedition Pvt. Ltd. advises all customers to carefully review our terms and conditions. By booking with us, you agree to these terms, forming a legally binding contract. This agreement acknowledges that you have read and understood all relevant information regarding your trip, and have provided accurate details on your reservation form.

Prices

The price is quoted for each trip, detailing all inclusions and exclusions as per the travel offer. Prices are primarily based on land costs, airfares, and prevailing exchange rates. While we strive to maintain these prices, factors beyond our control may necessitate adjustments. We reserve the right to modify tour costs at any time, including departure dates, due to reasons such as exchange rate fluctuations, fuel price changes, airfare adjustments, airport fees, and seasonal variations.

Booking and Payment

To secure your package, a 25% deposit of the total trip cost is required upon booking. Please note, this deposit is non-refundable. The remaining balance must be settled 30 days before your departure date, payable via cash or bank transfer. Failure to make full payment by this deadline may result in cancellation of your reservation without refund of the deposit. All prices are quoted in US dollars (USD).

For individual trips, bookings must be made at least 40 days prior to departure. However, trips to Bhutan, India and Tibet require full payment upon booking, with the completed and signed booking form sent to our office via email, along with the initial 25% payment.

Last-Minute Booking

Last-minute bookings are accommodated for Nepal trips only, where full payment of 100% of the travel cost is required within 24 hours to confirm your reservation. We are available at short notice for trips to Nepal; please contact us at +9779851014834 or via email at maxnepaltm@gmail.com However, last-minute bookings for India, Tibet and Bhutan trips cannot be accepted.

Cancellation and Refund

Cancellation fees apply if you cancel your trip after booking:

  • Cancellation 30 days (1 month) before departure: 5%

  • Cancellation 15 - 29 days (3 - 4 weeks) before departure: 40%

  • Cancellation 07 - 14 days (2 weeks) before departure: 75%

  • Cancellation 07 days or fewer (less than a week) before departure: 100%

Changes to your itinerary after confirmation require written notification at least 15 days before departure, with a 20% charge of the total cost to cover cancellation fees. Changes made less than 15 days before departure will be treated as cancellations, subject to the above cancellation fees. Unused airline tickets, accommodations, or other services will not be refunded.

Itinerary

Itineraries provided are intended as a guide for each adventure vacation, outlining accommodations, prices, passport and visa requirements, and health protocols. They are not contractual obligations but may be subject to changes, which we will promptly communicate. Detailed itineraries can be downloaded from our website or provided upon request. We recommend reviewing these details thoroughly before booking to ensure clarity on vacation specifics. You may cancel your reservation within seven days of receiving the itinerary if you feel it was not adequately understood, and we will refund your payment in full. This provision does not apply to reservations made less than eight weeks before departure.

Tibet Tours

All Tibet tours are conducted under the authority of the Tibet Tourism Authority. We are not liable for itinerary changes or cancellations due to circumstances beyond our control, such as road closures, political unrest, natural disasters, flight cancellations, illness, delayed arrivals, or changes mandated by the Tibet Tourism Authority. Additional costs incurred as a result are the responsibility of the customer. We strongly recommend obtaining comprehensive health, personal, and cancellation insurance to cover all planned activities.

Note

If you wish to extend your trip by up to one year without cancellation, you must notify us via email at least two weeks before departure and cover any additional costs resulting from price increases.

Trip Cancellation by Us

In the event we cancel your trip due to civil unrest, natural disasters, or other unforeseen circumstances beyond our control, your deposit and payments will be fully refunded, minus reasonable expenses incurred. However, we are not liable for uninsured losses or damages.

Passport & Nepal Visas

Travelers must possess a valid passport valid for at least six months beyond the return date. Nepal visas can be obtained upon arrival at Tribhuvan International Airport or Nepalese embassies/consulates in your country. Residents of certain countries, including Nigeria, Ghana, Afghanistan, Zimbabwe, Somalia, Cameroon, Swaziland, Iraq, Ethiopia, Liberia, and Palestine, must obtain visas in advance.

Travel Insurance

While we provide insurance for our employees (guides, porters, Sherpas, drivers), clients must arrange their own comprehensive travel insurance and provide proof of coverage before departure.

Acceptance of Risk and Liability

We strive to ensure a safe and enjoyable trip experience. However, we and our affiliates are not responsible for route changes due to circumstances beyond our control, such as natural disasters, road closures, regulatory restrictions, political unrest, flight delays/cancellations, illness, accidents, or other risks associated with adventure travel. By participating, you acknowledge and assume all associated risks, including but not limited to injury, illness, or death resulting from natural hazards. Our liability is limited to negligence or liability for uninsured property loss.

Health and Fitness

Travelers must be in good health and physical condition. Please inform us of any medical conditions before departure, as medical facilities may be limited in remote areas. Evacuation for medical emergencies can be prolonged, complex, and costly, with all associated expenses borne by the traveler.

Tour Leader Authority

By signing our reservation form, you acknowledge the authority of the tour leader regarding behavior, itinerary adjustments, and travel decisions affecting group safety and well-being. Participants who jeopardize group safety or health may be asked to leave the trip, with no entitlement to refunds for unused services.

Jurisdiction

This contract is governed by Nepalese law and falls under the jurisdiction of the Nepalese government.
